Question: When working as a temporary employee what are the guidelines? Is this illegal?
My friend working as a temporary employee for a company. She doesn’t know how long she will be there. So there is an opening in the same company in a different department. She doesn’t think she is beyond the guidelines if she applies for it on her own.
I told her to go for it. However the agency will NOT be happy if they found out. She said they its not like she is trying to apply for the job she is temping for behind their backs. I told her its the “Company” they have an account with so they still wouldn’t be happy about it.
But Staffing agencies don’t care about the employees they are more concerned about the employers thats how they make thier money. If the agency can’t make money then they are NOT happy bottom line.
Who’s right?
its an indefinite position possibly permanent. but she doesn’t want the job so she could be there for months. before shes done.

i dont see why they would care, and even if they did, what are they going to do about it. They cant stop someone from applying for a job. if i was temp and theres a job opening id apply.

Let me add details about a friend. He was terminated from a company on a layoff, made “not eligible for rehire” because he had problems with the manager (like insubordination etc.). Then when he applied to another large company the company’s HR-Staffing refused to take despite his name being recommended by interviewing panel. No background check was done as he didn’t fill any such form. Later he secretly found out through a friend that the second company didn’t take because “they came to know of ethical issues with his previous employer”. He immediately contacted his former company and it clarified that no personal data other than period of employment are revealed and also the second company never contacted them my friend. So how come the second company “come to know” this if former employer didn’t reveal anything? whether he had any ethical issue comes latter the first part is how could second company develop such a notion?

Depending on the industry, it is likely that someone from the first company (that he was laid off from) knows someone at the second company and, therefore, passed on that information to the second company unofficially….

The survey results come as the nation’s unemployment rate skyrockets to 14-year high of 6.5 percent in October, as 240000 more jobs were eliminated. This marks the 10th straight month of declines. The survey by the Fort Lauderdale-based recruiting and staffing company found that 77 percent of workers believe the economy is getting weaker. But the index also showed that 65 percent of workers are confident in the future of their employer. Thats up two percentage points from the September report. Job security remains high, with 74 percent of workers saying they believe they are unlikely to lose their jobs in the next 12 months. But, theyre also not willing to walk away from what they have, with just 31 percent reporting that they are likely to look for a new job. The survey of 2960 employed adults was conducted in October.
